Legal Question in Criminal Law in Texas

What happens now?

My husband is being charged with aggravated assult w/a deadly weapon and child endangerment, he has been in jail for domestic abuse (on me) several times but I have always dropped the charges. He has also being in jail for DWI (3). What kind of sentencing is he looking at? I am refussing to drop the charges this time, I have been putting up with this for 18 yrs. and I am tired of it. He also still has custody of our 9 yr. old daughter. If he is convicted and goes to prison will I get her back?

A jail is no place to raise a child. If he is sentenced to jail, you might have a reason to file a motion to modify a prior decree. A lawyer would have to look at all the circumstances to best advise you on this matter. A charge of child endangerment filed by the District Attorney would certainly make me think that a serious question is raised as to the safety of the child.
