Legal Question in Criminal Law in Texas
My husband has 8 or 9 charges on his record for forgery/fraud. He is currently serving time right now for his last charge at Bradshaw State Jail has done 7 months has 5 left. He has got a previous charge from right before he went for family assault against me. I want to get it dropped do I jave a good chance since this s his first charge of this kind and it's only a misd.? Or could he possibly get time served since he went in right after it happened and did a year. Its a class b misd. and the maximum he can get is a 2,000 fine, 6 months or both.
1 Answer from Attorneys
Check with his attorney. Often Misdemeanor charges are dismissed in felony pleas.
If not, the attorney may be able to do something to either get the charges dismissed, or to get him credit for the remaining time on his sentence.
