Legal Question in Criminal Law in Texas
My husband has been to prison before and was out on parole and just now went back to jail he's been there for 4 months and we still havent heard what they are going to do to him he hasnt been indicted or anything they say the new charges are the same that he was in there for the last time whats going on

It depends what is holding him. If it is just the new charge, then after 90 days without being indicted, he is entitled to either a bond in the amount he can make or a personal bond. The problem with this kind of motion is that it may encourage the State to go ahead and indict him quickly or to ask the judge to raise his bond (which would issue a new warrant) after he is indicted. I would suggest discussing this matter with his attorney or if he does not have attorney with an attorney who practices criminal law in that county.
