Husband in prison
Please help! My husband is in prison on a parole violation for a conviction in 1982. He received 60 years for burg. of hab./repeat felony offender/escape. The repeat case is a conv. in 1980 for burg. and was an illegal conviction. He got 8 years for that. the escape is also illegal because he was never arrested and was in hospital and walked out. How do we get rid of those two cases, so that we can file a writ of habeas on the 60 year conviction. The courts admit that they were illegal convictions, but sentence has been discharged and we cannot file a writ of habeas corpus on those. What do we need to file? Please help

You need to consult an attorney ASAP. If your husband had a terminal illness you would not hesitate to see a doctor. His life is on the line here. The practice of law is not about knowing what motions to file. Get serious about his life and stop the do-it-yourself effort.
