If my ex husband takes $ 3,000.00+ my adult daughters money from an account they both sign on (set up when she was a minor), money that he knows isn't his and uses it for his own use, is it stealing?

For it to be stealing, he has to take the property without the effective consent of the owner.
Is he an owner? This depends on how the account was set up. If he has been withdrawing from the account for some time and your daughter has known about it, it appears that the may have consented. Review the signature cards with the bank and an attorney.
