Legal Question in Criminal Law in Texas
identity theft
got a credit card in my ex's name and he found out about it and closed the account. i have since paid of the balance owed. It was under $1300.00. He has never pressed charges and it has been over a year now. Can he still choose to press charges? Is there a statute of limitations on things like this? Can he use this if he takes me back to court to get custody of our 15 year old son?

Re: identity theft
He might be able to get a criminal charge out of this situation, but the more time that goes by, the less likely that it would happen.
It would certainly be an issue in a custody fight, as it is indicative of credibility. It is not the only factor. In most cases, the preferences of a 15 year old would be more important.
