If you are talking about a felony, it takes the agreement of 2 of 3 officials - THE district attorney, THE judge on the case, THE sheriff of the county. It really does not happen often at all. The exceptions of which I am aware are when the defendant helped make cases against gang members, etc. in prison to the potential detriment of his health, and where the defendant is on death's bed and is released to some place like the VA.
