Legal Question in Criminal Law in Texas

Indicitment

My boyfriend is in jail waiting to go to court. He was arrested in April and yesterday 12/4/07 he was transported back to his original city of arrest. The sheriff found out that he had been in custody this entire time without them indiciting him on the charges and told my boyfriend that he was going to call the DA. My question is, is there a time limit on getting an indicitment and what happens if the time limit has been exceeded. He has been sitting in the same jail for all this time and has never seen in the inside of a court room nor had a conversation with his lawyer. Me and his mother are wondering what they are speaking about what, if any choices we have at this time?

It is not clear from your question whether your boyfriend was in jail in TX or NM from April to December. The answer to your question depends upon that information.
