Legal Question in Criminal Law in Texas
indictment statute of limitations
my son was arrested 2-22-06 for unlaw poss firearm and pcs. he adm guns were his and was charged and indicted. he was held in police car with another person on 2-22-06 and after being taken into custody police found con sub in police car. he denies it's his and had ct date 3-28-06 which was postponed because ''drugs were still at lab being tested''. he was indicted on pcs 7-19-06. the other person in pol car at same time also denied the drugs were theirs and were not charged. is this not questionable ?

Re: indictment statute of limitations
It absolutely casts doubt on the owner of the drugs. It is an issue to be addressed at plea negotiations, and if that fails, then at trial.
Not sure about the title of your question, as statute of limitations does not appear to be an issue here.
