Legal Question in Criminal Law in Texas
Indictments
Texas indictment contains more than one count of alleged crime under criminal episode article. During trial, except for primary count, the other was discovered expired by statute of limitations. Does this make the indictment void of prosecution and should it be dismissed?

Depends on whether the SOL for the primary count was the same as for the expired offense. If so, then a motion to dismiss sould be filed.
