Intoxication Assault
Can you be indicted for this charge when 1) the police report says there were no injuries 2)the hospital did a drug screen (which was negative) but not a blood alcolol test 3) the person in question was not given a breath test 4) the injured party left the country and 5) the person in question was not the driver(the driver fled the scene on foot while this person walked injured 5 miles for help(the accident was in a rural ara)

An indictment could be issued, particularly if there is other evidence, not provided here. Under these facts, however, it would be difficult to indict, and more difficult to prove.
