Involuntary Intoxication Manslaughter

I and my best friend had a car accident in March19,1997. We were both intoxicated. I was driving. We were both critically hurt,but after all the surgeries, I survived. My best friend died that same night. I had to stay in the hospital for over 2 months and now I'am handycapped for life. In Jan.25,2000 I was presented with a warrant for Intoxication Manslaughter and was take to prison. Im now out on bond. I was never before presented with any form of charges. What is the punishment for 1st time ofenders? What can I do to get min. jail time? The charge is been done by the state of Texas. I have no criminal record. The parents of my best friend don't want me in jail neither! Iam willing to serve time for my friend's death. Thank you.

This sounds like a situation straight from a Kafka novel.

Intox manslaughter is a second degree felony with a range of punishment ranging from 2 years probation to 20 years in prison. It sounds like you are in a prison of your own as it is. The main culprit will be our favorite sanctimonious neo prohibitionists at MADD, a organisation dedicated to punishing those who made a mistake while drinking. They often monitor these cases and remind prosecuters to file cases like this.

As you can tell, I have done battle with these fine folks and would love to take them on again. It seems to me that you have suffered enough. I was involved (in the back ground)with the Cesilee Hyde case in Austin and have been able to get good results for others in a similar situation by pointing out the extent of your injuries, making the state realize that the "victems" parents dont want this pursued and by making them look like a bunch of over zealous tyrants who are looking to further harm you.
