Legal Question in Criminal Law in Texas
I was issued a citation on 10/25/23 dates for 10/24/23 which was dated to need to be responded to by 11/23/23 (thanksgiving day). I entered my plea of not guilty by way of certified mail. The following week, I was contacted by the county clerk on Tuesday to notify me that the citation in question never arrived in their system. On Wednesday, the issuing officer called me and told me that the citation was improperly entered and would have to be reissued. The “reissued citation” is now dated for having been issued on 10/22/23, two days before its original date. Is this not grounds for dismissal based on perjury, as both dates cannot be true?

Perjury? The definition of perjury: the offense of willfully telling an untruth in a court after having taken an oath or affirmation. Sounds more like a mistake. Hire a lawyer.
