Legal Question in Criminal Law in Texas

okay so im going to jail in harris county for 5 days because i violated my probation will they give me 2 for 1 ? last time i went in they were giving 3 for 1 cause its so packed ! i got another question also if i get my papers sent to court for this class b misdemeanor theft case how long may i do i know the max is 180 days 6 months in county jail , but ive talked to plenty v.o.p lawyers and say its unlikely for me to get the max punishment either way , so can i have an experienced person in this matter opinion ?

No 2 for 1 on this violation of probation. You must serve the full 5 days. This is a "condition of probation" so it's day for day. Of course, the sheriff can do anything he wants!

On the Class B Theft case, the minimum jail sentence is 3 days and the maximum is 180 days. Your sentence, if you plead guilty or no contest to the charge, will fall somewhere within that range of punishment. Generally, a good lawyer will be able to get a favorable plea agreement for you and depending on the circumstances, facts of the case, and your prior history, you would generally be assessed in the low range. It is rare that someone gets 180 days, but it is also rare that someone just gets the minimum 3 day sentence.
