Legal Question in Criminal Law in Texas
Can I go to jail for selling something my girlfriend bought me!
1 Answer from Attorneys
If you have "proof" it was a gift to you, it belongs to you. Do you have witnesses to prove that she "gifted" this item to you? Are these people willing to come to court to testify on your behalf? Do these potential witnesses have clean criminal records?
If it is an item with a "title" and the title is not in your name, then it does not belong to you.
The item belongs to the person whose name is on the title.
I hope this helps. Your question is very broad.
If in doubt, I would be very careful. You might want to contact the police, sheriff or constable in your area BEFORE doing anything.
A mad girlfriend will often attempt to file "theft" charges if you have already notified the police and have an officer's name, cell phone number & badge number and the date & time of the contact, it might help you.
