Under the Texas Penal Code, aggravated assault, while using or exhibiting a deadly weapon is a second degree felony. If there is serious bodily injury, then it rises to the level of a first degree felony.
A second degree felony is punishable by 2-20 years and a fine up to $10,000.
A first degree felony is punishable by 5-99 years, or life; and a fine up to $10,000.
