Legal Question in Criminal Law in Texas
Hi,
My name is Karen and I have just recently moved from california to texas and I am looking for employment (of course) or possibly going back to school. I have seen a few jobs that I would like to apply for and a few classes I might like to take but they all mention something about possibly running a background checks now I am not afraid to talk about my past but I am different now. A few of these jobs I am interested in I would be applying to the state or the city for employment.I guess my question is first if they did run a background is it a state wide thing or just for the state your in at the time? Then if does show can it be expunged where it wont affect my employment chances and how can i do it? My past charges are I beleive a petty theft when I was very young (i am in my 40's now) a few paraphenalia and possesion charges, probation violation and last but not least a grand theft charge. At the present time I on neither parole or probation. Thank you for your time....Karen

Karen:
I do not know what state or government employers check. I assume that it would be a national check though.
You would have to apply for your expungements in California, not Texas. You will have to contact a California attorney, probably in the county where the offenses occurred.
Under Texas laws it does not sound to me as if you would qualify for an expungement for your probation violations. The law in this area would be governed by California law, not Texas law, and I cannot discuss California law without some degree of research.
