law question
IF a woman is 4 months pregnant, and her husband beats her, and the baby dies as a result of this beating, can he be charged with some for of murder.

The relevant statutes have changed with regard to this question. He very definitely CAN be charged with the death of the fetus. In the first case of its kind in Texas, a young woman was convicted of intoxicated manslaughter in the death of a fetus, among others, in El Paso in Spring 2005.

No. The baby must be born alive. However, there is some lively debate on-going about the question.
