Legal Question in Criminal Law in Texas

Lawyer didn't prevent arrest - why not?

Several months ago, my husband was told by police

that his former employers suspected him of

embezzling. We promptly went lawyer shopping and

settled on a fairly well-known attorney with a high

Martindale rating and good track record. He assured

us that he would be able to handle the case, should my

husband be charged, without my husband having to go

through the usual arrest/bail miseries.

Last week the attorney called and said that my husband

had been indicted, and he had arranged a court date

for the following week. He instructed my husband to

meet him at the court at 11:00am in the morning.

However, less than three hours before his court date,

the Sheriff's department showed up at our house, told

my husband that they had a warrant for his arrest, and

hauled him off in handcuffs. The attorney managed to

have him released on personal recognizance, but the

whole ordeal lasted eight hours.

My question is: if this court date had already been

made less than a week beforehand, why would a

Sheriff's department bother to send out officers and

make an arrest? It sounds like a lack of

communication on somebody's part, but I just can't

figure out whose.

It sounds like the left hand of law does not know what the right hand is doing. This happens often and I would not blame your lawyer.
