Legal Question in Criminal Law in Texas
Lawyer quitting a case
I have a family violence court case that has been picked up by the state even though my wife has decided not to press charges. My case goes to court on Monday (6/1) and my lawyer just quit after I have already paid him. Can I get my money back and what should I do about court on Monday?

Re: Lawyer quitting a case
Why did the lawyer quit? Have you had any court settings yet? If the lawyer is signed on as attorney of record, they cant just quit. They would have to file a withdrawal in court and the judge would have to approve it. As far as getting your money back, you would have to sue him on the contract, or try to go to the state bar and complain.
As far as Monday, you will need to tell the court that your lawyer quit and you will need more time to hire another lawyer.
