Legal Question in Criminal Law in Texas
My lawyer told me to take drugs before a polygraph. Is this ethical?
1 Answer from Attorneys
The answer is no, it is not ethical. On top of it being an ethical violation and likely a criminal law violation if the results of such a test are used, the attempt to defeat the test may be discovered which will likely make mattes worse. The only polygraph an attorney should advise a client to take is a private polygraph that is protected by the attorney-client privilege as the examiner is the attorney's agent. In this way, if the client fails, the prosecution never has knowledge of it. If the client passes, then the test results can be disclosed with no worries that the client tried to cheat the test by taking drugs.
An attorney that suggests unethical methods of winning, is likely an attorney that is unable to succeed based on intellect and skill. This is not an attorney you want to select. My suggestion is that you retain a Board Certified Criminal Law Specialist.
