Legal Question in Criminal Law in Texas
is it leagal for a police officer to seize a phone when being arrested, because you don't want to give them the password? and then not let it be released with your personal property when a family member comes to pick it up?

They can hold it as evidence until the end of the case. Your lawyer can ask for it to be released early if it is not evidence, and get a court order from the judge for release.
