Is it legal for police to find marijuana in my apartment after responding to a call that the back door was open?

If they enter under exigent circumstances because of a concern about injury, etc., and the pot is in plain view, then you are out of luck. If they had to search to find the pot, then you may be able to get the evidence suppressed.
