Legal Question in Criminal Law in Texas
Legal question
If a person elected to use the Pre-Trial Diversion Program for a misdemeanor offence, what will be the best answer for the following:
Have you ever been convicted of, or entered a plea of guilty, nolo contendere, or no contest to, a crime in any jurisdiction other than a minor traffic offense? You must put all misdemeanor and felonies, even if adjudication was withheld by the court so that you would not have a record of conviction.

Re: Legal question
The answer is 'no' - assuming that you were truly diverted from the system. Then it may depend upon who is asking the question. For instance, in immigration matters, it is necessary to list even pre-trial diversion.
