Legal Question in Criminal Law in Texas

Lieing on a deposition

What can be done about a person lying on a deposition? Isn't it a crime in Texas, my lawyer just let it pass by without question. What can be done by the paying client to see to it that the truth is told? This has put me in an emotional and financial bind for years. I need help from a lawyer that knows the LAW! Any help will be greatly appreciated. Thank you so much, N.Noble

Re: Lieing on a deposition

You need to speak with your attorney about why he/she let it pass. He/She may have a stategy or theory for letting it go. Additionally, the rules for depositions are not exactly the same as they are for the trial. If my law firm can assist you with this or any other legal issue, please contact my legal assistant Jennifer ([email protected]).

Re: Lieing on a deposition

Lying under oath on a matter that is material to the issues involved in the legal proceeding is a crime. But, perjury is rarely prosecuted because it is tough to prove.

Many people "lie" in deposition, and attorneys can only ask questions, they can't force testimony to be truthful. But, if they can prove it is not truthful at a trial or arbitration, they can show that the witness told a different and incorrect story at depostion and under penalty of perjury, and argue that therefore the witness is not worth of being believed.
