Legal Question in Criminal Law in Texas
Limitation!
I had a misdemeanor class ''A'' case. The case has been dismissed for little less than 2 years, but it has been more than 2 years from the date of offense. Is the case still tolling or I am ready to have my record expunged? If it is still tolling, then how does one calculate the tolling period on a misdemeanor in Texas? I am confused, some light on the issue will be greatly appreciated! Thanks.

The statute of limitations is tolled during the period of time between arrest and dismissal. You have to subtract that period, and accrue the two years. (Unless there was a finding by the court/jury of not guilty).
