Limitations on a felony

i was arested in march of 06, asualt with a deadly weapon, in tx,

i bonded out, my wife signed a affidavit of non prosicution,i was never indited,its been over 3 yrs, ive been walking on eggshells, my lawyer wont find out for me, she said for me to call the da''s office.

i dont want to call and raise a red flag and then have my case go to court, i waved a gun around during a fight with my wife, and i left and was later areseted.id love my life back,i have 3 little girls at home with my wife, when i was released from 45 days in jail, they told me i couldnt go close to her, nor talk to her, or see my kids, or id go back to jail, my girls havent had a dad in 3 yrs, yes wer still married,my kids late the disaplen cause im not ther, my wifes wants me back, but i rather die then go back to jail because of a fit of anger, and somethen stupid i did,if i have to ill call the da and take my chances.i have no criminal record, past or present, how do i get this behind me so i can go get a desent job, and see my girls and get my life back? i beleave its a agrivaited asualt with a deadly weapon, its a small city in tx, cops are sometimes jerks, sometime there really nice.please help! thanx!

Am not sure what it going on here. First, it is unethical for the ADA to talk to you when you are represented by counsel. If you are not satisfied with your representation, hire another lawyer. If the case has never even been set, then there is an excellent chance it won't be. If it is just grinding through the process of resets and continuances, then your lawyer may be doing a very good job for you. If it has fallen through the cracks, the prudent thing to do is to leave it there. I strongly recommend you not have ANY conversations with the DA's office.
