Legal Question in Criminal Law in Texas

how to list a past class c offenses on job applications.

Are all class c offenses misdemeanors. If so how do I need to reply to a job or school application question asking me to state whether or not I have plead guilty to a class c misdemanor and to explain the nature of the offense. To be more precise I plead guilty to a class c asault in 2005 but I was never charged, brought to court or sentenced to serve jail time. However I did have to post bail to get released from the detention center.

Hello there,

Since you were arrested and had to post bail to get out of jail, that arrest was reported to at lease the TCIC index system. That being so, even though the case was dismissed, you are going to have to explain that.

If you don't explain it and show it was dismissed, it might come back to bite you in the ass if the school finds it and then knows you lied on your application.

Getting arrested is not the end of the world. Civil Rights Advocates and many others have been arrested for protesting as well as many other things.

President Bush and Dick Cheney both were arrested for DWI. Cheney actually twice I think.

So the best policy is to be honest and explain the situation.

What you might do is contact the school and ask them if you need to disclose a case that was never filed in or prosecuted. The dean of admissions will tell you their opinion.

In life it is better to be safe than sorry. A few people I went to law school with were not allowed to take the Texas Bar Exam because they didn't disclose a stupid hot check.

Sincerely,

Erick Platten
