Legal Question in Criminal Law in Texas
My live in boyfriend's ex wife came over unannounced. She had the kids open the door when I went ot the restroom. I startled her. And that point she began verbally harrassing me. In which time I told her to leave. I had the door almost closed when she went ballistic. We struggled with the door. Then she proceeded to hit me. I had a bruise right chest and a hand/wrist injury requiring medical bills. The children (hers) were witness to the event. I qualified for domestic violence. But the da and prosecutor will not take case because they will not use kids.I am being told due to only kids as witnesses I am basically on my ownto continue the saga. I was told to contact the police again (which I did) each time it occurs. I am trying to prevent anything else occuring. I wanted a protective order because I have a daughter who was home at the time. And I worry about my safety. She was in contempt of court. The decree just states someone competent over 18 can be appointed by the parents to watch them.
1 Answer from Attorneys
The DA and the prosecutor are gutless wonders.
YOU are a witness to the assault. Nobody needs the testimony of children.
Forget those wusses at the DA's office. Hire a private attorney and apply for a protective order.
