Legal Question in Criminal Law in Texas
I live in Houston, Tx. and I was just notified by my boyfriend's attorney that the Miranda rights were only applicable to certain cases ie. murder, burglary etc.
To my knowledge these rights should be given each time a person is under arrest.
I think the lawyer is just getting his money, and he is very cheap as well. I need to get clarification on this and if there is a law stating that you dont read folks their rights no matter what type of crime it is.

Miranda rights are important only if the accused gave inculpatory (guilty) statements in response to custodial (in custody) interrogation. Questions answered before arrest; questions that are irrelevant; information volunteered not in response to questioning - these are not included. The only thing that happens if that the statements are suppressed at trial; the case continues.
