Legal Question in Criminal Law in Texas
How long after an aggravated assault on a family member does the victim have to file charges? If they don't want to file is it better to obtain or not obtain an affidavit to present to the court? Thank you

It is 3 years except in certain instances regarding the complainant's age.
I don't understand the affidavit portion of the question if there have not been charges filed. If there have been charges filed, then you need to talk to your lawyer but since you have put 024 of the zip code I assume that you are in Harris County where an affidavit of nonprosecution is not helpful a great percentage of the time.
