Legal Question in Criminal Law in Texas
how long?
My brother was just arrested for ''burglery of a building'' and ''resisting arrest'', on Dec.10,2006. For a first time charge on this what is the minimum and maximum sentence?

Burglary of a building is a state jail felony if the bldg was not a house. If it was a house then it is second degree felony. If it was as house and there was intent to commit another felony besides theft, then it is a 1st degree felony.
Resisting arrest is a Class A misdemeanor, unless there was a deadly weapon used, then it is a 3rd degree felony.
Class A misdemeanor -- jail for less than one year and/or up to $4000 fine
State jail felony - jail for 180 days up to 2 years and/or fine up to $10,000.
3rd degree felony - prison for 2-10 years and/or fine up to $10,000.
2nd degree felony - prison for 2-20 years and/or fine up to $10,000.
1st degree felony -- prison for 5-99 years and/or fine up to $10,000.
