Legal Question in Criminal Law in Texas

lost handbad in a movie theatre

I lost my handbad in a movie theatre at the last show of the eveing and i was the last one to exit the show at 12 midnight, only the cleaning crew would have access to the room after that time. When I went the next morning to claim my bag, they said they could not find it anywhere. What can I do? i had hundredes of dollars of medications in the bag, plus a mont blanc pen, (300.00), check books and other valuable items. The theatre has no hard fast policy for lost items, is there any recourse I have? thank you very much

It doesn't constitute theft, unless there is some evidence linking the use of the property to the thief.

You can sue the theatre in civil (JP) court, but your chance of success is not good, and would probably require their willingness to settle with you. In my opinion, the court will determine that it was your negligence, not the theatre's negligence, that caused the damages.
