Was the phone found in your house? Where? If not, did the police search? You do not have to allow them to search if they do not have a warrant.
Even if the phone was found in your house, the police would have to connect it to someone (just like drugs found in a house. They can't just charge everyone who lives there or comes or goes - there has to be a connection between the item and the individual.)
