Legal Question in Criminal Law in Texas
If a male is 23 and has sex with a 14 year old girl. He says it was consensual and admits to having sex. Yet he says he did not know her age at the time, is it still punishable after the fact? I know that under 14 can not give consent, but is he at fault for not knowing her age?

I'm not sure what you mean by "punishable after the fact", but yes, a 23 year old having sex with a 14 year old is very definitely a crime in Texas, regardless of what the girl did or said or wanted or represented about her age. The offense would be Sexual Assault of a Child, which is a second degree felony, subject to a 2-20 year prison term, as well as lifetime sex offender registration.
