Legal Question in Criminal Law in Texas

On March of 2007 I was arrested for a misdemeanor assault in Texas, I was processed, magistrate, and later released on bond, its been a little over 4 years and I have not heard from this case and was never processed to the county attorneys office. Will the statue of limitation be a good defense to try and dismiss this case?

Have you tried to contact the county clerk to see if the case is actually still pending? And, if you used a bail bondsman, then it seems weird that they have not been contacting you. Do you have a lawyer? If so, follow whatever advice that lawyer gives you because they are more knowledgeable about the surrounding circumstances.

The statute of limitations is tolled while the case is pending so that has not run BUT you may have a good argument for a speedy trial dismissal. (Not exactly but a good lawyer could try and make that work for you if the case was pushed.)
