Marijuana Charge Texas

I was in the vehicle with 4 other friends and the marijuana 2but 4 ounces was in the back of the truck so it was not in my posession and i was not the driver but one of the passengers is agreeing to testify against me that i knew it was there. Will i still be able to get this dismissed?

Possession of contraband or a drug in Texas is defined as "care, custody, control, or management."

Just knowing that the drugs were there does not mean you had possession. It obviously helps if you dont know its there, but you have an argument.

I agree with the other answer in that the district attorney's office is not in the business of dismissing cases. Some counties dismiss more often than others, some hardly dismiss at all. In this situation, your best bet is likely going to be at trial.

Make sure to get yourself a good lawyer who will fight the case for you all the way through trial.

What I always tell clients who ask this question is that the prosecutor's office is not in the business of dismissing cases. Your only chance to tell your side of the story is at trial. You absolutely need to hire a lawyer!
