Legal Question in Criminal Law in Texas

to marry or not

hello,my boyfriend and i are both being charged for the same crimes,our house was ran in on in june of 2002.we we're arrested on fraudulent use of/or poss. of identifying information and possession of a controlled substance,we are wanting to know if us being married would make any difference. thank you so much for any or all help,me.

Rule 504 of the Texas Rules of Evidence discusses when a spouse may be called and when a communication may not be used. If not already formally married, there can be a common law marriage which could affect this rule. Also, rules of probation and parole declare that a person may not associate with convicted persons. If there is a marriage, that may still be a violation of that rule, but it may be something they might not enforce against a spouse which they might otherwise enforce against a boyfriend or girlfriend. You should discuss these things with an attorney hired to represent you in the case.
