Legal Question in Criminal Law in Texas

matters occuring after speeding ticket

If additional legal matters, such as p.o.m., occur after being stopped for a speeding violation; and the speeding ticket ends up being dismissed by trial, would that be grounds for the p.o.m. to be dimissed as well?

It may possibly be grounds upon which the second charge could be challenged, but not necessarily. It would depend upon the facts of the case and the legal reason why the speeding charge was dismissed.

Hello there,

It does not matter that the speeding ticket was dismissed.

There is still going to be a marijuana charge.

Police are instructed not to give minimal traffic citations in these cases because during a traffic trial one could file for a motion to suppress based on an unconstitutional stop.

If you win the motion to suppress at the traffic ticket court level all the evidence acquired is suppress and cannot be used since is call fruit of the poisonous tree.

If my office can be of any assistance feel free to contact us.

Sincerely,
