Legal Question in Criminal Law in Texas

I am a Minnesota resident returning from a cross-country road trip. On September 16th I was stopped at the Border Patrol checkpoint off I-10 in Sierra Blanca, TX. A small amount of Marijuana in the trunk triggered the dog. This led them to the discovery of a few small mushroom caps and one tiny sliver of LSD on blotter paper. Border Patrol assessed the value of the Psilocybin at $20 and the LSD at $1. I admitted the drugs were mine so my brother could be released. I was brought to the Hudspeth County jail, where I remained for roughly two and a half days. They formally charged me with a third-degree felony for the mushrooms, and a state-prison felony for the acid.

I am 29 years old and otherwise have a completely spotless record. What am I facing here? What are my chances of bargaining these charges down to misdemeanors so I'm not labeled a felon for the rest of my life over $21 worth of non-addictive personal drugs? How much should I expect to pay for decent representation in this case? Thank you for your help.

It's pretty conservative out there, but since it's your first offense I would imagine they'll let you plea to a lesser charge and/or get deferred adjudication along with some type of fine and probation. If you have any questions, I'd be happy to answer them. 512-472-8318
