Legal Question in Criminal Law in Texas

Misdemeanor

I have a class A misdemeanor for Family Violence in Texas, for holding the wrist of my fiance from hitting me. She wrote a statement against the police dept. and a non-prosecution affidavit, but the state picked it up and the local PD went full throttle against me. I was charged and took a guilty plea to get out of jail at 30 days. Now, I want to join the military, but I can't because of this conviction. How can I get it removed?

Re: Misdemeanor

You probably can't get it removed. Even if it were within the time limits of appeal, you probably waived your right to appeal when you entered the guilty plea. Rarely, there are issues which might result in a cause to reopen. You may want to retain an attorney to review the entire file to see if there is anything available to you.
