Legal Question in Criminal Law in Texas
Can you please tell me if you can have a misdemeanor theft 40.00 expunge from your record if you pleaded guilty or was charged? It is affecting me getting employment. This occured about 6 years ago. If so, please advise the process to have it removed and if not, please explain why? Thank you.

If you plead guilty, you have a conviction. Convictions can only be expunged if you receive a pardon from the governor. A theft under $50 is a class "C" misdemeanor.
Last time I checked, the Texas Commission on Pardons and Paroles will not look at applications for pardons of class "C" misdemeanors.
If you can't get a pardon, the only way for an expunction is to find a lawyer who will file the application even though you are not entitled to it and hope that it will not be opposed.
