Legal Question in Criminal Law in Texas
my mom was sent to state jail in janurary of 2011 after being arrested in december 2010 for misappropriation of a jusicial instrument ( what ever that means). On march 22 2012 she was released but rearrested there for a charge of theft that was filed while she was in prison. remind you this is her second stint with state jail she is currently in county jail. Could they dismiss this or will she probably get another sentece, she has along criminal record. Thank you for your help.

They could dismiss the case but given that they filed it while she was in prison, presumably knowing she was in prison, and because she has a "long" criminal record, it is more likely they will proceed with the prosecution.
