if my moms holding marijuana in order to convict her child who gets the charge

Both can be convicted. Mom cannot intentionally and knowingly possess marijuana. That said, a prosecutor has discretion on what cases to pursue and if the mom found the marijuana, called police and turned it over, most prosecutors would not pursue a case against mom (unless mom has marijuana priors.)
