moving to Canada, son just got arrested

My 17 yr old was arrested for possesion of marijuana and we are moving to Canada a month after his court date, will he be able to move with us? What do you recommend we do so that he can move with the family?

The actual charge and disposition of your son's case is a critical issue here. You need to consult a Canadian immigration lawyer to determine what the guidelines are to allow his admission into Canada, if he is not a Canadian citizen. Under US immigration law, even deferred adjudication for some drug offenses will exclude admission. That Canadian immigration lawyer should consult with your son's Texas criminal defense lawyer. His criminal defense lawyer might be able to obtain a disposition of the case based upon him leaving the country, if the charge is a minor one. If your son is not a US citizen, and wishes to return at a later time, the disposition of the case will affect his reentry in some cases.
