Legal Question in Criminal Law in Texas
Mtr/criminal nonsupport
My husband has a court date on 12/02 for an Attorney withdrawl. He is currently incarcerated in a county jail for MTR on Criminal Nonsupport. He has been in jail for 2 months....my question is this. Why won't the Judge set a bond? Also, I would like to know what could possibly happen in court on the 2nd besides the Attorney withdrawl. Do we have any hope of the Judge possibly setting a bond that day??

I am assuming your husband has a Motion to Revoke Probation and was not a Deferred Adjudication. If he was on a Deferred Adjudication, your husband would be charged with a Motion to Adjudicate and your husband would be entitled to a bond, although it might and probably would be a high bond. If he is in custody for a definite Motion to Revoke Probation he is not entitled to a bond although some judges, depending on who it is might give him one. Particularly whether it is a misdemeanor or felony Court Judge. Second, probably nothing more will happen on December 2, than the issue of whether the Attorney can withdraw from representing your husband. If the Judge grants the withdrawl, he may appoint an attorney to represent your husband. Without more information, I cannot answer your questions any better than I have at this time.
