Legal Question in Criminal Law in Texas
Negligence of serious cardiac problems
My husband has had a 5 way heart bypass 10 yrs. ago. He was recently arrested and is being held. He is having severe problems: Tachycardia, numbness of arms and hands, and purple hands on exertion. I have tried to get him seen by a cardiologist. The jail doctor won't do anything, siting the fact that the 2 EKG's showed no changes.( EKG's show eletrical activity...not circulation status). This same scenario happened when he originally had cardiac problems many years ago. All tests were negative until they finally did an arteriogram , then wanted to take him to surgery immediately. The nurses just say "take 3 nitroglycerin" which lowers his BP dramatically.
How can I get them to take this seriously? I want him taken to a qualified cardiac specialist for testing. Whatever happened to "Innocent until proven guilty?" Can I file suit to force them to take this action?
If he were not incarcerated, I would have him in the emergency room. If he dies, or has a stroke, are they not liable for not taking proper steps?
Thank you for your attention to this.

Serious cardiac problems
You don't say what he was arrested for! What about bond? You need a local attorney to take his message to the judge in charge of his case as see if you van get a "ROR" (release on own recognisance authorized.
In addition, find a civil rights lawyer in your area and talk with him - often a good solid threat of suit can do wonders It might also help to take your doctor's report to the sheriff and ask him, and then remind him that if your husband has to be hspitalized while he is a prisoner, it can cost the county and his budget cubic dollars.
