Legal Question in Criminal Law in Texas
negligent homicide
Hi my husband was in a accident and the
other party that was involed pass away.
They ticketed him for failure to maintain
lane control and was dismissed. Now they
are trying to charge him with negligent
homicide. They say that he was under the
leagal limit for alcohol, but he does not
drink. What grounds do they have to do
this.

You say they are 'trying to charge him' -- has he been charged? He needs a lawyer. If no traffic offense was committed at the time of the accident, this might be stopped at the grand jury stage. If there was a traffic offense, then it still might not rise to the level of criminally-negligent homicide. Get a lawyer.
