Legal Question in Criminal Law in Texas
My nephew was arrested for his third DUI. He first was in Arkansas a few years ago, he second was last October in Texas and his third was this past weekend in Texas. He has a charge against him in Arkansas for assulting his sister. My question is will the assult charge be considered when determining his sentence on the 3rd dui. Or will the Texas court even be aware of it.

Texas will be aware of it and while it is not likely to raise the minimum / maximum in the case, it can affect what he is offered.
