Can non-attorneys file motion for bail reduction?

Husband's court appointed attorney not doing anything to get him out. All we want from this man is to try for bail reduction. bail is set at 35,000. charge: felon in pocession of firearm. He doesn't has any ''no-shows'' and I need him out so he can help me pay private attorney. I can get the form for bail reduction and fill it in using legal terms and such but SHOULD I AND CAN I?

Hello there,

Unfortunately, you cannot file the motion for your husband because you are not an attorney.

However, your husband can file a motion himself since he is the one being charged.

He should file a motion to fire his current attorney stating the reasons he wants to fire him and at the same time file a motion for a bond reduction.

Since he is in jail he has access to a law library and may have access to some legal forms that can help him with the law.

If he is able to write these out in his own handwriting he should both mail them to the District Clerk and also give another copy to a Sergeant at the Jail these motions will be filed and he will have his day in Court.
